These Terms and Conditions (“Terms”) govern your access to and use of the PayVista platform, including our website, mobile applications, products, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use PayVista.

1. About PayVista

PayVista is a fintech company based in Burundi providing digital financial services including:

• Mobile money float distribution for various mobile money partners support;
• Mobile money agent support and float financing;
• Access to microloans and other credit facilities for our network of agents;
• Payment and money transfer solutions; and
• Tools to promote financial inclusion in underserved communities.

Our mission is to make banking and payments easy, secure, and accessible to everyone.

2. Eligibility

To use PayVista Services, you must:

• Be at least 18 years old;
• Possess a valid national identification or passport; and
• Have the legal capacity to enter into binding agreements under applicable law.

3. Account Registration

You must create a PayVista account to access most Services. When registering, you agree to:

• Provide accurate, current, and complete information;
• Keep your login credentials confidential; and
• Immediately notify PayVista of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

4. Use of Services

You agree to use PayVista Services only for lawful purposes and in accordance with these Terms. You must not:

• Use the Services for fraudulent, illegal, or unethical activities;
• Violate any laws, regulations, or third-party rights;
• Interfere with the operation or security of the platform; or
• Create multiple accounts to misuse promotions or features.

5. Fees and Charges

PayVista may charge transaction fees, service fees, or interest rates on loans as clearly communicated before any transaction. All fees are displayed transparently within the app or website before confirmation.

We reserve the right to update fees at any time with prior notice.

6. Float Financing and Loans

By applying for float financing or a loan through PayVista:

• You authorize us to verify your information and assess creditworthiness;
• You agree to repay all amounts owed within the specified terms;
• Failure to repay on time may result in penalties, suspension of your account, or legal action.

PayVista may report repayment history to credit bureaus in accordance with applicable laws.

7. Mobile Money and Payments

When using PayVista for transactions:

• You authorize PayVista to process, transfer, and settle funds on your behalf;
• Transactions are final once confirmed;
• PayVista is not responsible for errors resulting from incorrect account numbers or recipient details provided by the user.

8. Security and Data Protection

We take your privacy and security seriously. PayVista uses encryption, secure servers, and authentication processes to protect your data.

Your personal data is processed in accordance with our Privacy Policy. By using our Services, you consent to such processing.

9. Intellectual Property

All PayVista content;including trademarks, software, graphics, and text,is the property of PayVista or its licensors. You may not copy, modify, or reproduce any part of the Services without prior written consent.

10. Limitation of Liability

PayVista shall not be liable for:

• Any loss or damage resulting from unauthorized access, system downtime, or third-party service interruptions;
• Indirect, incidental, or consequential damages; or
• Loss of profits, data, or goodwill.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the specific service giving rise to the claim.

11. Termination

PayVista may suspend or terminate your account at any time if:

• You violate these Terms or applicable laws;
• Fraudulent or suspicious activity is detected; or
• Required by a financial regulator or law enforcement authority.

You may close your account at any time through the app or by contacting customer support.

12. Changes to the Terms

We may update these Terms from time to time. Updated Terms will be posted on our website or app and take effect upon posting. Continued use of the Services after such updates means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Burundi. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of Burundian courts.
